| Background: | School districts with charter schools operating in their boundaries may be obligated to provide facilities for charter school students under Proposition 39. Education Code 47614 requires that public school facilities be shared with charter schools and that districts provide charter schools with sufficient facilities to operate that are in reasonably equivalent condition to those in which the students would attend if they attended district schools. School districts must make an effort to provide charter schools with facilities near to where the charter school wishes to operate and cannot move a charter school unnecessarily. This presentation reviews the requirements as outlined by Education Code and Proposition 39 and presents possible scenarios that could meet the facility needs for each charter school operating within AUSD. |
