Background:

The California School Board Association (CSBA) supports the repeal of the contingent cap on local reserve levels. The cap was enacted via the education budget trailer bill, SB 858, Section 27, and is now codified in Education Code Section 42127.01. Section 27 states that in the fiscal year following a year in which the state transfers money into the Public School Stabilization Account, known as the Prop. 98 reserve, school districts will be required to spend their assigned and unassigned ending balances down to no more than twice the level of their minimum recommended reserve for economic uncertainties. 


CSBA urges governing boards to adopt resolutions to repeal the cap—SB 858, Section 27/California Education Code 42127.01.
