Federal IDEA funds allocated to the State of California and other funding from the State of California will be distributed by Special Education Local Plan Areas (“SELPAs”) to be used to provide Educationally Related Mental Health Services (“ERMHS”) to students with disabilities as determined by their IEP.
The federal law includes a requirement for educationally related mental health services for children with disabilities who require such services to benefit from special education. These services include mental health assessments and (for students who qualify) educationally related mental health services (including residential board and care costs for students with Mental Health disabilities).
The attached MOU is the joint agreement of all Alameda County SELPAs and Behavioral Health Care Services for the next three years. The parties have collaborated and entered into this MOU in order to work together for the provision of ERMHS to students with disabilities who receive such services as part of their IEP.
