Item Title:Approval of AUSD’s Final 2015-16 Facilities Offers to Academy of Alameda (AOA) Charter Middle School and Academy of Alameda (AOA) Charter Elementary School

Background:Education Code section 47614 and its implementing regulations at 5 C.C.R. 11969 (known as “Proposition 39”) require school districts to offer charter schools space in district school buildings. Charter schools receive space in district buildings based on the number of in-district students they are projected to enroll, and the amount of space allocated to comparable district schools serving the same grade levels as the charter schools.

At its January 27, 2015 meeting, the Board approved a preliminary offer of space on the Chipman campus for the Academy of Alameda Charter Middle School and Academy of Alameda Charter Elementary School. Under the preliminary offer, the AOA Charter Schools would share the campus with the District’s Adult School. The preliminary offer had the effect of combining the space allocations for both AOA Charter Schools in a way that preserved more room in the building for the Adult School.

The Proposition 39 process requires the District to make a final offer of space prior to April 1, after the AOA Charter Schools have had time to review and respond to the preliminary offer. The attached proposed final offer would give Adult School and the AOA Charter Schools the same amount of space on the Chipman campus as the preliminary offer. The proposed final offer also specifies which rooms each school will have and incorporates a facilities use agreement which would govern the AOA Charter Schools’ use of the building.

Because it is providing space in District facilities, the District can charge the AOA Charter Schools a fee equal to 3% of the total revenue they receive under the state's Local Control Funding Formula. The District could charge additional fees during the coming school year if either of the AOA Charter Schools falls materially short of its in-district enrollment projections. Revenue received by District will vary based on enrollment.
