Background:

A Project Labor Agreement (PLA) is a master collective bargaining agreement between construction trade unions and a project owner. It establishes working site conditions and management rights prior to the start of project construction.

In October, the Board directed staff to negotiate a PLA that would apply to projects funded by the District’s Measure I bond program.

Since that time, staff has preliminarily agreed on the material terms of a PLA with the Alameda County Building and Trades Council. This presentation sets out those terms and conditions so that the public and the Board can weigh in. Staff expects to bring the PLA itself to the Board for approval at the Board’s May 24, 2016 meeting.

Goals:
Fund:Measure I Bond. The PLA would govern the expenditure of a material percentage of Measure I funds. As discussed in this presentation and a related presentation made at the Boards October 13, 2015 meeting, PLAs in our area do not automatically increase labor costs because the prevailing wage and union rates are essentially identical. However, there is a risk that some projects (especially smaller projects) could see fewer bidders because of the PLAs requirements. The terms and conditions of the proposed PLA include provisions meant to minimize that risk.
