On June 23, 2020, the Governing Board approved a resolution declaring the District's Former Maintenance Yard (located at 2615 Eagle Avenue, Alameda, CA 94501) "exempt surplus," and authorizing District staff to file a waiver of certain property sale procedures.
Prior to submitting a waiver application, the District is technically required to hold a public hearing to receive comment. Prior to taking action on June 23, the District allowed for public comment, but did not formally open a public hearing.
The State Board of Education's staff has opined that the District's procedure substantially complied with the hearing requirement, and that it would be sufficient to allow the State Board to approve the waiver application.
Nevertheless, in the interest of strict compliance, transparency, and public participation, the District wishes to hold a public hearing prior to passing a resolution.
Tonight, staff is recommending the Board hold a hearing, and pass this resolution, which would (1) authorize staff to file a waiver application; (2) declare the property "exempt surplus land;" and (3) authorize staff to file a CEQA exemption relating to the sale of the property.
