Item Title:Resolution No. 2019-2020.30 Authorization to Declare Emma Hood Swim Center Property Exempt Surplus Land per Assembly Bill 1486

Background:
 

A recent bill, Assembly Bill 1486 (“AB 1486”), significantly altered how school districts and other public entities dispose of surplus property.  Effective January 1, 2020, school districts must provide notices of availability to housing development agencies and park and recreation departments whenever a district-owned property is declared surplus, with special priority given to agencies willing to develop affordable housing on the property.  However, such restrictions do not apply to “exempt” surplus properties which, under the newly expanded Government Code section 54222, includes school property that is reviewed by a district advisory committee (so-called 7-11 committee) and declared exempt by the Governing Board. 


With this resolution, the Emma Hood Swim Facility which was reviewed previously by a 7-11 committee is declared “exempt surplus property.”
